(L.A.) Ismael Hernandez, 35, Died in a Hospital

Los Angeles County is reporting the death of a 35-year-old Latino male that occurred in a hospital.

The coroner’s office identified the man as Ismael Hernandez.

Manner of Death: Homicide

Cause of Death: Gunshot Wounds

Formal pronouncement of death was made on Sunday.

On June 28, the decedent was walking near the intersection of Avalon Boulevard and 42nd Place when he was shot in the back by LAPD.

The suspect was not aiming his revolver at the officers. He was also not attempting to flee. Despite this, he was shot in the back—a clear violation of the standard established in Tennessee v. Garner.

He was taken to the hospital and charged with assault enhanced with special allegations relating to his possession and discharge of a firearm. The six charges were dismissed after he died.
